Terms of Service

By accessing ezitech.net or subscribing to EziDigest, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use our services.

These terms constitute the entire agreement between you and EziTech Solutions Pty Ltd (ABN 45 667 613 783) ("EziTech") regarding your use of our services.

EziTech provides:

• **IT Consulting Services**: technology strategy, implementation, and managed IT services for businesses. • **EziDigest Newsletter**: an AI-curated technology newsletter delivered via email on a Free or Pro subscription basis.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to affected users.

To use EziDigest, you must create an account with a valid email address and agree to these terms. You are responsible for:

• Maintaining the confidentiality of your account credentials. • All activities that occur under your account. • Notifying us immediately of any unauthorised use at security@ezitech.net.

You must be at least 16 years of age to create an account. Accounts may not be transferred or shared.

**Free Plan**: Available to all registered users at no cost. Includes 3 newsletter issues per week, top 5 article summaries, 1 language, and 30-day archive access.

**Pro Plan**: Available at $9 AUD/month (monthly billing) or $79 AUD/year (annual billing), inclusive of GST. Includes all Free features plus daily delivery, top 10 articles, all languages, full archive access, and integrations.

**Billing**: Pro subscriptions are billed in advance via Stripe. By subscribing to Pro, you authorise EziTech to charge your payment method on a recurring basis.

**Cancellation**: You may cancel your Pro subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods unless required by Australian Consumer Law.

**Price changes**: We will provide 30 days' notice of any price increases via email.

You agree not to:

• Use our services for any unlawful purpose or in violation of any applicable law. • Reproduce, redistribute, or resell newsletter content without written permission. • Attempt to access other users' accounts or our backend systems without authorisation. • Use automated tools to scrape, index, or harvest content from our website or newsletters. • Send spam, phishing, or malicious content through our contact or integration features. • Interfere with the operation of our services or infrastructure.

Violation of these restrictions may result in immediate account termination.

All content on ezitech.net, including newsletter articles, summaries, designs, and code, is the intellectual property of EziTech Solutions Pty Ltd or its licensors, except where third-party sources are credited.

EziDigest newsletters are delivered for your personal, non-commercial use. You may share individual articles with appropriate attribution but may not republish full issues or derive commercial products from our content without a written licence agreement.

The EziTech and EziDigest names, logos, and trade marks are owned by EziTech Solutions Pty Ltd. Unauthorised use is prohibited.

Our services are provided "as is" without warranty of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

EziDigest newsletter content is provided for informational purposes only and does not constitute professional IT, legal, financial, or investment advice. We do not guarantee the accuracy, completeness, or timeliness of any information published.

While we strive for high availability, we do not guarantee uninterrupted or error-free service delivery.

To the maximum extent permitted by Australian Consumer Law, EziTech's total liability to you for any loss or damage arising from your use of our services is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, data, or business opportunity, even if advised of the possibility of such damages.

Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Australian law.

EziDigest newsletters contain links to third-party articles and resources. These links are provided for your convenience; we are not responsible for the content, privacy practices, or accuracy of third-party websites.

Inclusion of a link does not constitute endorsement by EziTech.

We may suspend or terminate your account at our discretion if:

• You breach these Terms of Service. • We receive a valid legal demand to do so. • We discontinue the relevant service.

You may close your account at any time by contacting us at hello@ezitech.net. Upon termination, your right to use the services ceases immediately, subject to data retention provisions in our Privacy Policy.

We may update these Terms of Service from time to time. We will notify you of material changes via email at least 14 days before they take effect. Your continued use of the services after the effective date constitutes acceptance of the updated terms.

If you disagree with a change, you may close your account before the effective date.

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
